Abstract in English: This research scrutinizes the impact and effect of the unforeseen circumstances on the financial contracts by Shariah laws and whether the Al-Fiqh provisions that are applied in cases of financial contracts are sound. The research starts with the essence of the consensual contract and its apparent intention by adopting both the inductive and analytical approaches and evaluating different doctrines of the Islamic jurisprudence. The conclusions of the research show that there is a clear consistent juristic theory in its foundation in dealing with the unforeseen circumstances of financial contracts. The theory is based on varying interpretation of contracts affected by unforeseen circumstances and the mismatch correspondence to it factually. This theory presents a pragmatic solution in light of the objectives of Shariah and its general rules.
