Abstract

This research deals with a jurisprudential rule which is irtikab Akhaff al-Dararayn or "rule of commission of lesser of two harms". The researcher focuses on clarifying this rule, its controls, its background, the legitimacy of this rule and other jurisprudential rules which are related to it. Moreover, the researcher demonstrates the impact of this rule on the Islamic call (da'awa) through contemporary applications.The study utilized three methods of research; first, the inductive approach which was used for collecting past and present doctrinal views related to this issue, second, the comparative approach which was used to combine and compare the different views of Islamic scholars regarding this rule and its impact on the call to Islam, and the finally, the analytic approach which was used to analyze the Islamic texts and jurisprudential views in order to have an Islamic judgment to apply the rule. The study concludes that complex developments are witnessed in this age in all aspects of life, whether at the personal or at the institutional level, and whether it is related to Islam or those who are calling to Islam. Srenuous efforts from Islamic scholars are required to find solutions, creating convincing answers to justify the acts by taking into account the interests, evils and the balance between them. In other words, no excessive expansion in warding off evil or negligence in widening the interest is needed in order to have basic compromising and balancing.
