Abstract in English: The research aims to shed light on the issue of human trafficking in the Algerian law from an international perspective. it addressed the concept of the trafficking in human beings and the legal and institutional mechanisms that deter such crime in international and Algerian law. The problem of the study is that the legislative provisions in the Algerian law make the penalty not severe since the crime in the penal code has been described as a severe offense and a crime when the conditions for emphasis are present. The definition of trafficking in human beings is not fully consistent with the protocol to prevent, suppress and punish traffickers. it aims to introduce the crime of trafficking in human beings as provided for in Penal Code 09-01. the statement of Algeria's efforts to mitigate the effects of its status in the second classification by the Office of the United States Department of State and to propose that the occasion be dealt with in the light of the best model and practice in international law. The research takes the inductive, analytical, comparative and applied approach and concludes that Algerian law has included a set of penalties for the criminals of trafficking in human beings when criminally held accountable in some respects in conformity with international law and guarantees the rights of victims. the legislative branch has included legal gaps that violate the rights of victims in particular and society in general, so it is necessary to establish and enact a law on the crime of human trafficking, which is independent of the penal code 09-01. in conclusion, the researcher presented the proposals and recommendations that ensure that Algeria gets rid of the classification in which it was placed.
